  • Identity & Account Data: First name (and optionally surname), email address, anonymous device identifier, date of birth or age range. Purpose: Account management, support, beta communications, device association, and basic personalization.
  • Voice & Audio Data: Voice recordings, speech-to-text transcripts, and optional voice biometric data. Purpose: Processing spoken interactions and identifying the speaker (if biometric enrollment is explicitly chosen).
  • Conversation Content & Memories: Full history of interactions (text and transcripts), extracted memories (facts, preferences, health context), and embeddings. Purpose: Ensuring continuity across sessions, semantic search, and recalling past context.
  • Profile & Personalization Data: Names and relationships of mentioned family/friends, routines, user preferences, and optional emergency contacts. Purpose: Tailoring ELVIS's responses and managing optional notifications.
  • Usage & Technical Data: App usage patterns, device model, OS version, IP address, and performance metrics (crash logs). Purpose: Fixing bugs, enhancing performance, and analyzing how the Service is used.
  • Payment Data: Processed securely by third parties (Stripe, Apple, Google) if premium features are activated. ELVIS does not store credit card numbers.
We do NOT collect: browsing history outside the ELVIS app, device contacts, precise location/GPS data, social media accounts, or photos stored on your device.
3. How We Use Your Information
We use the information we collect to operate, maintain, and improve the ELVIS Service — including facilitating conversational AI interactions, remembering preferences and conversation history, delivering notifications (if requested), recognizing you via voice biometrics (if enrolled), analyzing usage to fix bugs and develop features, and sending account-related updates and support messages.
Crisis Situations: If ELVIS detects signals of crisis (e.g., suicidal ideation, abuse, or immediate danger), the system is designed to suggest emergency resources such as 988 or 911. ELVIS does not automatically contact authorities or family members without your explicit prior setup.
4. How We Share Your Information
We share your data only to the extent necessary with trusted third-party service providers:
  • Anthropic (Claude AI) — AI Processing: Receives conversation content via API to generate responses. Does not use API data to train models by default.
  • Voyage AI — AI Processing: Receives conversation snippets to generate embeddings for semantic search. Data is processed and not retained.
  • ElevenLabs — Voice Services: Receives text generated by ELVIS to synthesize voice responses. Does not receive your voice data.
  • Tavily — Search: Receives search queries when ELVIS needs current information (e.g., weather, news).
  • Replit, Neon (Postgres), Cloudflare — Infrastructure & Hosting: Hosts the application, stores user profiles, conversation history, memories, and embeddings.
  • Sentry — Monitoring: Receives error and performance data, configured to filter out PII and conversation content.
  • Stripe, Apple App Store, Google Play — Payment Processing: Process payments subject to their respective privacy policies.
We may also disclose your information if required by law, to protect our rights or property, or in the event of a merger or acquisition.
5. Data Retention and Deletion
Conversation history and memories are retained indefinitely to provide continuity, unless you request deletion. Voice biometric data is retained only until you disable biometric identification or delete your account. Account data is retained until you request account deletion. You can initiate deletion via the in-app option or by emailing us at [support@example.com]. All data will be deleted within 30 days of a verified request.
6. Your Privacy Rights
Depending on your jurisdiction (including California, Virginia, Colorado, Connecticut, and the EU), you may have the right to: access copies of all data ELVIS holds about you; data portability; deletion of your account and associated data; correction of inaccurate data; opt out of voice biometric enrollment at any time; and know what categories of data we collect and which third parties receive it. 8. Voice Biometric Data Policy
If you choose to use our optional voice identification feature, we collect and store voice biometric data (voiceprints) subject to protections under laws such as BIPA (Illinois), and Texas and Washington laws. We will only collect voice biometric data after obtaining your explicit, informed consent. The sole purpose is to identify you within the ELVIS app. This data is permanently destroyed when the feature is disabled or the account is deleted. We do not sell, lease, trade, or otherwise profit from your biometric data.
9. Children's Privacy (COPPA)
ELVIS is intended strictly for adults (18+) and seniors. We do not knowingly collect personal information from children under the age of 13. If we discover that a user under 13 has provided personal data, we will immediately delete that account and all associated information. Caregiver & Family Member Consent
Required for the Family Alert Feature
ELVIS includes optional safety features designed to alert designated family members or caregivers if the AI detects signals of a crisis (such as expressions of severe distress, confusion, or potential harm). Because this feature involves sharing the ELVIS User's personal data and conversation context with a third party, we require explicit consent from both the User and the designated Caregiver/Family Member.
For the ELVIS User
By designating a Caregiver or Family Member as an emergency contact within the ELVIS app, you agree to the following:
Consent to Share Information

Scope of Information Shared

You can remove a designated Caregiver from your account at any time through the app settings, which will immediately stop future alerts to that person.

Not a Medical Service
You understand that ELVIS is an AI companion, not a medical device or professional monitoring service. Alerts are generated by algorithms that may be inaccurate, delayed, or trigger false alarms.
Your Responsibility
You acknowledge that [Company/Organization Name] is not responsible for the User's safety. If you receive an alert, it is your responsibility to assess the situation and, if necessary, contact emergency services (911) on the User's behalf.
Confidentiality

Welcome to the ELVIS Beta Program! We are thrilled to have you try our new AI companion app. Because ELVIS is still in development, please read this agreement carefully. By using the ELVIS Beta app, you agree to these terms. If an adult child or caregiver is setting this up on your behalf, they are agreeing to these terms for you with your permission.

What Is a "Beta" App?
"Beta" means the app is still being built and tested. It is not a finished product. Because of this, you might experience glitches, the app might crash, or ELVIS might occasionally say things that don't make perfect sense. We are providing ELVIS to you "as is," without any guarantees that it will work perfectly all the time.

Not for Medical Emergencies
ELVIS is a companion, not a doctor or an emergency service. You should never use ELVIS for medical advice or in an emergency. If you are hurt, sick, or in danger, please call 911 or your local emergency number immediately. By using this app, you understand that ELVIS cannot call for help for you. Your Feedback Is Valuable
The main reason we are running this Beta program is to learn from you! We may ask you for feedback on how ELVIS is working and how we can improve it. If you share ideas or suggestions with us, you agree that we can use those ideas to make ELVIS better without owing you any compensation.

We may end the Beta program, change how the app works, or remove your access to the app at any time, for any reason. You can also stop using ELVIS at any time. When the Beta ends, we may delete the data and memories ELVIS has saved during this testing period.

If you are an adult child, family member, or caregiver setting up ELVIS on behalf of a senior user, you confirm that you have explained what ELVIS is to them, and that you have their permission to agree to these terms and the Privacy Policy on their behalf.
